Badar Al Raisi advises on a range of international disputes, with a focus on complex (re)insurance coverage disputes across multiple lines and has particular experience in high-level excess liability (re)insurance written on the Bermuda Form (New York law with English arbitration procedure).

Badar’s experience of coverage disputes regularly involve jurisdictional issues and aspects of foreign law, often involving coordination in various jurisdictions and working with teams of lawyers.

Badar also has broad experience of acting in a range of international commercial arbitrations and investment treaty disputes (acting for both states and investors), under ad hoc and institutional rules, including under ICC, LCIA, UNCITRAL and ICSID rules.

EXPERIENCE

  • Acting for an insurer in international arbitration proceedings concerning a coverage dispute under a D&O policy over an underlying US securities fraud settlement.
  • Acting for insurers against U.S. policyholders in arbitration claims for alleged losses arising out of the COVID-19 pandemic.
  • Acting on behalf of multiple insurers in separate arbitrations concerning a coverage dispute over a product recall claim in respect of losses in excess of USD300m and arising from products installed in residential homes in the U.S.
  • Acting for multiple insurers on claims arising from lawsuits against participants in the pharmaceutical supply chain and in relation to the opioid-related misuse crisis in the U.S.
  • Acting on behalf of multiple insurers in separate arbitrations concerning a coverage dispute with a mining operator in the U.S.
  • Acting on a number of pharma and biotechnology disputes arising from U.S. product liability claims.
  • Acting for an investor in a USD105m ICSID claim against Azerbaijan arising out of an investment in the construction sector under the Turkey-Azerbaijan BIT.
  • Acting for a South Asian State in defending a treaty claim under the UNCITRAL Rules brought by a Middle Eastern investment fund.
  • Advising a sovereign wealth fund in a series of long-running multi-billion US Dollar claims in respect of derivative investments that arose from transactions allegedly procured by a fraudulent and corrupt scheme.
