Badar Al Raisi is a Senior Associate in the Litigation & Regulatory team in London. He specialises in complex (re)insurance coverage disputes and international arbitration, with a particular focus on high-value claims involving global insurers.

He advises on coverage disputes across a broad spectrum of (re)insurance lines, including first-party property, D&O, trade credit and political risks. Badar has particular experience in high-level excess liability (re)insurance written on the Bermuda Form (New York law with English arbitration procedure) and has acted in a number of Bermuda Form arbitrations. His experience includes coverage disputes arising from large-scale environmental incidents such as oil spills, as well as mass tort claims in the pharmaceutical and life sciences sectors, including those relating to opioids, medical devices, and product liability.

Badar has acted in arbitrations under all major institutional rules (including ICSID) as well as in ad hoc proceedings. He regularly advises on matters involving allegations of fraud, misrepresentation, and breach of contract. He is particularly familiar with complex, multi-jurisdictional disputes and frequently works as part of cross-border legal teams to deliver coordinated and commercially focused outcomes.

EXPERIENCE

  • Acted in multiple successful anti-suit injunctions before the English courts to restrain U.S. proceedings brought in breach of arbitration agreements, including representing the successful respondents in the Court of Appeal in John Wood Group Plc v Chubb EU & Ors [2022] EWCA Civ 781, which upheld an injunction restraining Canadian court proceedings arising from the failure of an oil pipeline in Alberta that resulted in the release of 5,000 cubic metres of bitumen into the environment.
  • Acting for an insurer in international arbitration proceedings concerning a coverage dispute under a D&O policy over an underlying US securities fraud settlement.
  • Advising and representing leading Lloyd’s market insurers in connection with multiple high-value aviation coverage disputes and litigation arising from the Russia-Ukraine conflict and related sanctions, across jurisdictions including the UK, US, and Ireland, involving both Contingent and Operator exposures.
  • Representing a global (re)insurer in Commercial Court proceedings concerning a claim exceeding US$400 million, involving alleged breaches of duty and misappropriation of trade secrets.
  • Acting for insurers against U.S. policyholders in arbitration claims for alleged losses arising out of the COVID-19 pandemic.
  • Acting on behalf of multiple insurers in separate arbitrations concerning a coverage dispute over a product recall claim in respect of losses in excess of USD300m and arising from products installed in residential homes in the U.S.
  • Instructed, alongside DLA colleagues in the U.S., to provide coverage and monitoring counsel in connection with bad faith (E&O) claims brought against an insurer in the U.S.
  • Acting for multiple insurers on claims arising from lawsuits against participants in the pharmaceutical supply chain and in relation to the opioid-related misuse crisis in the U.S.
  • Advising Bermuda insurers on coverage issues arising from PFAS-related product liability.
  • Acting on behalf of multiple insurers in separate arbitrations concerning a coverage dispute with a mining operator in the U.S.
  • Acting on a number of pharma and biotechnology disputes arising from U.S. product liability claims.
  • Acting for an investor in a US$105 million ICSID claim against Azerbaijan arising out of an investment in the construction sector under the Turkey-Azerbaijan BIT.
  • Acting for a South Asian State in defending a treaty claim under the UNCITRAL Rules brought by a Middle Eastern investment fund.
  • Advising a sovereign wealth fund in a series of long-running multi-billion US Dollar claims in respect of derivative investments that arose from transactions allegedly procured by a fraudulent and corrupt scheme.
