Dr Samir Buhl advises national and international companies on all aspects of employment law, with a particular focus on strategic litigation (Employment Litigation).

He regularly represents his clients in complex employment law disputes before employment courts and civil courts, particularly in disputes with managing directors and senior executives.

Samir advises holistic, sustainable and economically sound. Clients value him as a long-term trusted advisor who develops legally sound and pragmatic solutions.

His advice ocusfocusses on Litigation and conflict resolution, in particular on Disputes between managing directors before civil courts, Dismissal protection claims, Disputes about variable remuneration (e.g. bonuses, commissions, cryptocurrency models), Litigation support following internal investigations, and All types of disputes relating to works constitution law.

In addition to Employment Litigation, Samir also advises companies strategically on the operational structure, particularly regarding Labour leasing and EOR-models, Co-determination rights of the works council, and Structuring and/or avoiding a TUPE.

EXPERIENCE

  • Successful representation of several national and international companies in court proceedings, in particular with regard to dismissal protection lawsuits (complex proceedings), disputes with managing directors, claims for payment of variable remuneration and claims under works constitution laws (including successful contests of works council elections).
  • Conducting internal investigations and supporting the subsequent litigation (often in conjunction with other practice groups).
  • Successful defense of an unjustified million-dollar lawsuit filed by a trade union on the basis of a social collective bargaining agreement.
