Waldo Randal has broad legal experience with a focus on natural resources and the environment.

Waldo has experience advising both central and local government clients across a range of subject areas including resource management, public works, building and other regulatory issues.

He regularly appears at council hearings, and in various matters before the Environment Court and High Court, and also has experience in alternative dispute resolution processes.

Waldo has acted for local and central government clients in judicial review proceedings, complex civil proceedings, and in other regulatory litigation.

  • Acting in Environment Court declaration proceedings concerning the interpretation of rural subdivsion provisions. See Better Living Landscapes Ltd v Auckland Council [2024] NZEnvC 326.
  • Acting in a complex High Court appeal concerning a proposed regional landfill facility in Auckland. See Te Rūnanga o Ngāti Whātua v Auckland Council [2024] NZHC 3794.
  • Acting in Environment Court and High Court appeals relating to a private plan change request to enable expansion of a private hospital and concerning the relevance of the National Policy Statement for Urban Development 2020 in this context. See Eden Epsom Residential Protection Society Inc v Auckland Council [2024] NZEnvC 161, and Southern Cross Healthcare Ltd v Eden Epsom Residential Protection Society Inc [2023] NZHC 948, [2023] NZRMA 511.
  • Acting for a local authority in its successful defence of an Environment Court appeal against a decision to decline resource consent for a proposed three-lot rural subdivision. See Barbican Securities Limited v Auckland Council [2023] NZEnvC 174.

  • Successfully defending judicial review proceedings relating to the grant of resource consent to a film studio in Takanini. See Alpha Dairy NZ Ltd v Auckland Council [2020] NZHC 1517.
  • Acting in a civil proceeding, determination and District Court appeal relating to the requirement to obtain a compliance schedule for a cable car under the Building Act 2004. See Ford v Auckland Council [2020] NZDC 22162.
  • Acting in various civil proceedings (and threatened proceedings) involving tort based claims in the context of regulatory decisions of local authorities.
  • Successfully oposing an application for leave to extend time for a civil appeal. See Banora v Auckland Council [2022] NZHC 1517.
  • Acting for a local authority in a successful prosecution of a company and its employees in relation to the unlawful discharges of sediment laden stormwater. See Auckland Council v Eminens International Ltd [2021] NZDC 6595.
  • Acting for a local authority in the successful prosecution (following a defended trial) of a dog owner for a serious dog attack under the Dog Control Act 1996. See Auckland Council v Sykes [2021] NZDC 10150.
