EXPERIENCE

  • Acting for an established financial institution in winding-up proceedings against the sole shareholder of a Hong Kong insurance company in respect of indebtedness under bond-linked notes amounting over USD200m; represented client in multi-jurisdictional settlement negotiations.
  • Acting for the trustees-in-bankruptcy of the bankruptcy estate (with claims exceeding HKD130bn in aggregate) of a high-net-worth individual and founder of a Hong Kong-listed conglomerate in relation to cross-border asset tracing, recovery and preservation proceedings across multiple jurisdictions.
  • Acting for the real estate investment arm of a Fortune Global 500 financial services group in relation to the enforcement of arbitral awards with outstanding debt of approximately USD1bn, including the realization of security over 300 million shares in a Hong Kong-listed property company and related cross-border enforcement and recovery strategies.
  • Acting for client in a probate dispute involving one of Hong Kong’s most prominent business families, and representing client in ancillary proceedings in the Mental Health Court and Family Court of Hong Kong.
  • Acting for the liquidators of an offshore company with substantial underlying assets in the PRC in relation to liquidation, asset recovery, insolvency and unfair preference proceedings, including obtaining Norwich Pharmacal disclosure orders, and pursuing claims to set aside transactions on the grounds of unfair preference. The matter involves debt claims exceeding USD1.4bn.
  • Acting for a 50% shareholder of a private company in a complex shareholder dispute involving unfair prejudice allegations, claims for breach of fiduciary duties and alleged misappropriation of company assets. Advising client on valuation issues arising from a buy-out order, and coordinating with forensic accountants on investigations into fund flows and alleged fraud.
