Aurélie Borgat is an associate in the IP & IT department of DLA Piper.

She advises French and international companies on technology related contentious matters.

Aurélie assists clients on a wide range of issues such as distressed IT projects, IT procurement litigations, cyberattacks, data related disputes, liability resulting from use of software AI tools as well as liability of technical intermediaries and removal of unlawful online content.

She is also involved in the prevention and handling of disputes relating to software and database infringement.

Her expertise further includes contractual and tort liability, as well as the application of sector‑specific and cross‑sector regulations governing digital products and services.

EXPERIENCE

  • Assisting a leading global network of sports channels in the first proceedings ever launched in France on the ground of article L. 333-10 of the Sports Code and obtained the first French dynamic blocking injunctions for two major sport competitions internationally renowned;
  • Advising an international software publisher and integrator to successfully navigate a pre-contentious situation within the context of a multi-million strategic IT project (negotiation strategy, preparation of letters to increase negotiation leverage and drafting of contractual amendment and settlement agreement allowing safe continuation of the project);
  • Assisting an international software publisher throughout a dispute in front of French courts, including during technical judicial expertise;
  • Assisting a major actor of the food industry sector in the management of an audit conducted by a major software provider;
  • Advising a leading player in the financial sector in proceedings against a saas service provider after the failed implementation of an artificial intelligence project;
  • Assisting a marketplace in, notably, the management and analysis of its LCEN notifications;
  • Advising a leading real estate player in the drafting and negotiation of its IT contract.
