About

Joe Roselius tries high-stakes cases. He is Co-Chair of DLA Piper's Bankruptcy Litigation Subgroup and has led teams to trial in matters totaling over $1 billion in controversy. His practice centers on bankruptcy litigation, private equity disputes, cryptocurrency and digital asset disputes, and complex commercial litigation.

Joe advises debtors, creditors, creditors' committees, and trustees in Chapter 11, Chapter 7, and cross-border insolvency proceedings throughout the United States. He litigates fraudulent transfer and preference claims, adequate protection fights, claim objections and estimations, appointment and confirmation contests, and other contested matters for bankruptcy stakeholders. He also represents private equity funds and their portfolio companies in post-closing acquisition disputes, purchase price adjustments, earn-out disputes, breaches of representations and warranties, fraud claims, and indemnification disputes. He represents both relators and defendants in False Claims Act and whistleblower investigations.

Joe serves on the Firm's national hiring committee for litigation and previously served as the Chicago office hiring partner. He is also on the faculty of the Firm's Trial Practice and Procedure Conservatory and various associate academies, where he teaches cross-examination and other trial skills.

Bankruptcy, Restructuring, and Cryptocurrency Litigation

  • Tried $300 million cryptocurrency claim valuation dispute to judgment in Delaware Bankruptcy Court
  • Tried two $225 million post-acquisition disputes to judgment in New Jersey Bankruptcy Court on behalf of a successful stalking-horse bidder
  • Represented lender in $800+ million dispute regarding loans to bankrupt cryptocurrency exchange—one of the largest crypto bankruptcy matters in the country
  • Recovered over $40 million for Chapter 7 trustee of a Singapore-based private jet company in adversary proceedings arising from a commercial bribery and kickback scheme
  • Represented liquidating trustee of pharmaceutical companies in adversary proceedings to claw back over $60 million in fraudulent transfers arising from federal antitrust violations

Private Equity Litigation

  • Represents private equity funds, sponsors, and portfolio companies in post-closing disputes, purchase price adjustments, earn-out disputes, indemnification disputes, breaches of representations and warranties, and fraud
  • Won affirmative summary judgment for fund in $25 million breach-of-contract dispute, resulting in favorable settlement
  • Represented fund in option exercise dispute with former portfolio company executives
  • Represented executive in buyout arbitration with fund, resulting in favorable settlement

Healthcare, Whistleblower and False Claims Act

  • Represents and advises relators and defendants in whistleblower and qui tam lawsuits
  • Represented healthcare practice in a dispute with practice management company
  • Won dismissal with prejudice of $10+ billion qui tam claims under the False Claims Act against government subcontractor for improperly painting military vehicles
  • Represented Midwestern grocery store chain in $80 million qui tam action under the False Claims Act alleging anti-kickback violations and retaliation against a former pharmacist whistleblower
  • Represented leading health information technology company in qui tam action under the False Claims Act alleging upcoding and Medicare and Medicaid fraud
  • Represented dental support organization accused of violating Medicaid regulations and retaliating against whistleblower
  • Investigated fraud and embezzlement allegations at a major private university

Other Business and Commercial Disputes

  • Represented chemical company in bet-the-company trade secrets dispute spanning the United States, the Netherlands, and Turkey, securing a favorable resolution for the company
  • Represented workers' compensation insurer in bet-the-business-line Illinois Consumer Fraud Act class action, securing a favorable resolution for the company
  • Represented workers' compensation insurer in series of nationwide putative class actions and individual disputes asserting violations of insurance regulations and Illinois Consumer Fraud Act
  • Deployed a non-traditional litigation strategy to win summary judgment and affirmance on appeal for Chicago real estate developer in breach of contract action, allowing a new deal to proceed without litigation delays
  • Won dismissal with prejudice of breach of fiduciary duty, unjust enrichment, and aiding and abetting claims against unlisted REIT and its directors and officers for allegedly inflating the value of the REIT's shares, pushing through an allegedly ill-timed listing and public offering, and other misrepresentations to shareholders
  • Won dismissal with prejudice of securities fraud and breach of fiduciary duty claims against unlisted REIT, its sponsor, and its directors and officers for allegedly inflating the value of the REIT's shares
  • Won dismissal of false imprisonment, malicious prosecution, defamation, and conspiracy claims against several Qatari and Kuwaiti companies and leading businessmen relating to disputes with American CEO
  • Won reversal of trial court's order holding reporter in contempt for refusing to disclose confidential source 
  • Represented two of the world's leading airlines in a multi-billion-dollar dispute with the City of Chicago over the expansion of O'Hare International Airport

Pro Bono

Joe maintains an active pro bono practice and has been recognized by the Firm and outside organizations for his work improving access to justice and reducing procedural barriers for low-income and indigent individuals. His recent pro bono representations include developing legislation to limit civil asset forfeiture and to end money bond in Illinois, improving criminal justice data sharing in Cook County, ensuring indigent criminal defendants were not forced to choose between receiving appointed counsel and posting bail, and preventing procedural abuses of low-income and pro se litigants in eviction court. Joe also regularly files amicus briefs in high-profile litigation matters.

Joe serves on the boards of the Les Turner ALS Foundation and the School for Little Children in Evanston, Illinois, and formerly served on the board of the Chicago Appleseed Center for Fair Courts.
