Yan Grinblat is a seasoned litigator with broad experience defending clients in shareholder, consumer, and privacy class actions.

He has represented numerous private and public companies, including some of the world’s largest technology, retail, hospitality, and food service companies, in consumer and privacy class actions. Yan has successfully defended claims at all stages of litigation, including cases alleging violations of state and federal privacy and consumer protection statutes, as well as class claims alleging consumer fraud, breaches of contract, and breaches of warranty. Yan also advises clients regarding compliance with privacy laws.

Additionally, Yan has represented numerous corporations, financial institutions, and insurance entities in the defense of securities class actions and shareholder derivative claims, which resulted in securing dismissal of those claims at the motion to dismiss stage, class certification, and summary judgment. Yan also represents these clients in internal and regulatory investigations and enforcement actions.

Yan also maintains an active pro bono practice.

Consumer and Privacy Class Actions
  • Defending Magnificent Seven software company in lawsuit alleging unjust enrichment based on purported improper information sharing with user of client’s technology; secured dismissal at the motion to dismiss stage
  • Representing national residential management company in putative class action challenging lease terms and management practices
  • Representing Fortune 10 technology company in three consumer class actions alleging violations of Illinois and California data protection and consumer privacy laws. Secured first ever dismissal with prejudice on a motion to dismiss in an Illinois Biometric Information Privacy Act case, which was affirmed on appeal
  • Representing Travel + Leisure (Formerly Wyndham Destinations) in four class actions in three different federal courts alleging violations of consumer protection statutes, consumer fraud, and breach of contract. Motions to dismiss granted in two actions; class certification denied in one action; summary judgment granted on most claims in one action
  • Defended international food and beverage company in several consumer actions challenging the company’s commitment to recyclability, adequacy of its label disclosures, and contents of its products. All cases were either dismissed at the motion to dismiss stage or settled on favorable terms.
  • Defended global snack food maker in putative consumer class action following data breach. After most claims were dismissed at the motion to dismiss stage, secured classwide settlement on highly favorable terms for client
  • Defended J. Crew Group in multiple class actions alleging violation of consumer privacy statutes in federal and state court. Obtain dismissal of federal court action, which was affirmed by the Third Circuit Court of Appeals
  • Represented multinational hotel chain in federal consumer class action seeking to certify a nationwide class of purchasers in connection with alleged consumer data privacy violations
  • Obtained favorable resolution of statutory consumer fraud claims against major retailer alleging improper labeling
  • Advised professional sports franchise regarding mitigation of litigation risk and compliance with federal privacy statutes
Shareholder Class Actions
  • Representing leading energy company in two securities class actions and two associated stockholder derivative actions in connection with the company’s hydrogen production and powerplant construction targets. The first securities complaint and first derivative complaint were dismissed at the motion to dismiss stage; a motion to dismiss the second securities complaint is being briefed; the second derivative complaint is stayed
  • Represented a major insurance company in a securities class action, as well as three follow-on stockholder derivative actions filed in federal and state court. Achieve dismissal with prejudice of two derivative actions and stay of third derivative action, as well as reversal of class certification in the securities action before the Seventh Circuit Court of Appeals
  • Obtained dismissal of securities claims against specialty insurer Atlas Financial and two Atlas executives; case was settled on highly favorable terms following dismissal of initial complaint
  • Defended former executive of medical device manufacturer in stockholder class action, follow-on derivative action, and regulatory investigation alleging violations of securities laws
  • Prevailed on multiple motions to dismiss on behalf of audit firm in two separate securities class actions

  • Representing Domino’s Pizza in a breach of contract dispute with a software vendor
  • Defeated TRO filed against mezzanine lender, permitting the lender to proceed with foreclosure sale and recoup the value of its investment
  • Defended a major insurance company in dispute with a software vendor alleging breach of contract. Achieved dismissal with prejudice after discovery with no client contribution
  • Obtained injunction against competitor on behalf of international waste management and infrastructure company to preserve client’s trade secrets and customer base
  • Represented CEO of construction company in business dispute alleging breach of contract and fraud. Motion to dismiss granted with prejudice
  • Achieved favorable resolution of commercial dispute on behalf of international investment fund against commercial real estate developer
