FCC announces Covered List exemptions for certain routers and UAS

The Federal Communications Commission (FCC) announced that the Department of War (DoW) has granted conditional approvals for certain routers, uncrewed aircraft systems (UAS), and UAS critical components, exempting those devices from the FCC’s Covered List. The action was announced through a series of public notices released on April 14 and April 22, 2026.

DoW has reviewed submissions and granted conditional approvals for the following devices:

UAS

  • Sees.ai v.USA. 1.0 UAS – terminating December 31, 2026

Routers

  • Netgear, Inc. – Nighthawk consumer mesh, mobile, and standalone routers (R, RAX, RAXE, RS, MK, MR, M, and MH series); Orbi consumer mesh, mobile, and standalone routers (RBK, RBE, RBR, RBRE, LBR, LBK, and CBK series); cable gateways (CAX series); and cable modems (CM series) – terminating October 1, 2027

  • Adtran, Inc. – Service Delivery Gateway class routers – terminating October 1, 2027

  • Amazon Leo routers – terminating October 31, 2027

  • eero LLC – eero, eero Pro, eero Max, eero PoE, eero Outdoor, and eero Signal routers – terminating October 31, 2027

As detailed in a previous client alert, producers of foreign-made routers and UAS may apply for a conditional approval from the DoW or the Department of Homeland Security. If granted, this approval would provide an exemption from the Covered List restrictions on equipment authorization for up to 18 months. Conditional approval requires detailed disclosures regarding corporate structure, manufacturing, and the supply chain, as well as a time-sensitive plan to establish or expand US-based manufacturing.
