Luis Parada leads the Labor & Employment practice group of DLA Piper Chile and serves as Latin America’s Practice Group Leader in Employment.
Luis has an extended and recognized experience advising local and foreign clients in matters, such as, adaptation of gig economy services to local standards, compensation and benefits for senior executives, stock option, RSUs and other incentive plans, collective bargaining, high complexity labor litigation and internal investigations (i.e. antiunion practices, harassment and discrimination, impairment of human rights), global mobility, handbooks and policies, termination of high ranked officers and reductions in force, labor due diligence processes, board directors and managers training sessions, among other matters.
He also regularly advises clients about workforce restructuring and outsourcing, proprietary information and assignment of invention agreements, implementing employment restrictive covenants and tax contingencies of labor matters.
Luis is a member of the Centro Chileno de Derecho del Trabajo A.G., the Chilean National Chamber of Commerce, Services and Tourism (CNC) employments´ commission and the Chilean Association of Metallurgic and Metal Mechanic Industries (Asimet).
Several (national and international) platform companies: Advised clients in adaptation of business model to new standards of “independent worker of platforms” law, before enactment of new statutes on the matter.
Top notch international company: Assisted the company in a negotiation with the union of acquired company, with a high stake of work force unionized, to adapt the existing CBA in order to equalize benefits to global standards of that company.
Successfully assisted an international industrial gas company in its collective bargaining, taking part in the negotiation table.
Assistance of international life sciences company, in drafting a policy for remote work outside the country.
Supporting an important local agri-business conglomerate in retention of key executives, preparing sophisticated agreements and analyzing different tax and labor consequences for the client.
Assistance of international company in the negotiation of non-compete agreement with a former general manager.
Assistance of a retail conglomerate in a complex collective bargaining with its union, in order to adapt benefits to a new economic reality.
Defense in court of local subsidiary of an important international food producer, in a series of wrongful termination claims due to fraudulent administration.
Advised an international life sciences company in its local employee’s transfer strategy, related to the global carve-out of an important line of business.
Advised an international fintech, in the employment and tax treatment of a Stock Option Plans and Restricted Stock Units plan, offered and paid by a foreign entity to employees of the local subsidiary.
We assisted an international catering company, in the transfer of an important foreign manager to Chile, equalizing a more favorable employment treatment of severance compensation, according to the home country practices of that person.
Support to a top notch think tank, in a complex termination of an employment agreement, with focus in correct allocation of copyrights for the client.
Client in the field of sea ports: Advice the client with the retention of key executives and employees, during the closing operations process of the local company.
Successful representation, in court of an international producer of mining, construction and forestry equipment, in an antiunion claim initiated by the Labor Directorate.
