Elena Preotescu is a highly qualified employment lawyer, with 15 years of experience exclusively in the Romanian labour law, with a specific focus in several sectors, such as in Transport (mainly Aviation), Life Sciences, Technology, Agribusiness and Energy. Elena has also specialized in several niches, ranging from immigration and health and safety to complex archiving formalities and procedures, including in the GDPR context of data retention. She is recognized by the Legal 500 directory as a Rising Start.

Elena’s employment qualification and skills developed in connection to both local and international companies and her in-depth sector knowledge allows her to fully understand operational and business needs and, thus, helps her to act as a trusted adviser for her clients in relation to all employment related matters including with respect to: the conclusion, execution, amendment and suspension of individual employment agreements (considering particularities of specific sectors and organizations), complex restrictive covenants, termination of employment (including sensitive high-end exits and disciplinary terminations), immigration-specific advice, employee mobility and enhanced flexibility matters, remote working, collective negotiations up to execution of collective agreements, internal policies.

Elena has also significant expertise on transactional matters, including transfers of undertakings, but also particular knowledge in relation to labour audits, employment litigation and discrimination claims in front of the Romanian Anti-Discrimination council. Elena is also actively involved in pro bono work and is a regular speaker to the DLA Romanian annual employment conference.

  • Advising a global leader in consumer Cyber Safety – on virtually all employment implications related to its entry on the Romanian market, as a result of the acquisition of a computer security software company, as well as advising in the post-acquisition phase on a full spectrum of labour matters.
  • Advising a leading integrated cloud communications platform by providing sophisticated employment law guidance on complex employment matters, including on disciplinary aspects, sensitive mutual termination, working time arrangements / on-call policy, as well as electronic signing of employment documentation, factoring our in-depth knowledge of the Technology sector.
  • Advising one of the leading low-cost airlines in Europe, in complex and sensitive employment matters, including industrial relations as well as several complex "class action" litigations in relation to employment contract terminations claims and other employees' rights.
  • Advising one of the leading international pharmaceutical company that focuses on iron deficiency, infectious diseases and consumer healthcare on various employment matters, including in relation to updating internal policies with a view to secure compliance with law, but also alignment with market practice, employee bonus and benefits schemes, rules on working and rest time.
  • Advising a leading, global renewable energy company devoted to value creation, innovation and sustainability on various employment matters (including termination of the employment, working time rules), but also in employment litigation in relation to salary rights claims, together with our litigation team.
