Kareena is an Associate in the Litigation, Arbitration and Investigations Group at DLA Piper and is based in Dubai. Kareena has worked extensively on construction and engineering disputes across a range of sectors including roads, rail, social infrastructure, renewable energy and commercial and retail developments and under a range of infrastructure structures, including FIDIC, public private partnerships, engineering, procurement and construction and design and construction.

Kareena has acted for principals, main contractors and subcontractors across the Middle East and Australia under leading institutional rules including ICC, DIAC and DIFC-LCIA.

EXPERIENCE

  • Acting for the MEP contractor in an DIAC arbitration in relation to unlawful termination claim, call on the performance bond and the contractor’s claims for extension of time and recovery of outstanding payment entitlements in connection with an ultra-luxury resort and residences in Dubai under UAE law.
  • Acting for the Employer in an DIFC-LCIA arbitration concerning the recovery of liquidated damages, a call on the performance bonds and the contractor’s claims for extension of time in connection with a luxury mall in Abu Dhabi under UAE law.
  • Acted for a major electricity transmission network with tendering parts of its network services to a successful bidder including drafting and negotiating the operation maintenance contract and finalizing the agreement with the successful bidder.
  • Undertaking a risk analysis for a major Global Battery Operator across a portfolio of supply, installation, maintenance and EPC contracts and advised the relevant client in relation to the risks identified during that review.
  • Advised the EPC contractor on contractual claims and contract management concerning three solar farms in Australia, including drafting contractual notices and correspondence, reviewing and considering contractual positions and providing strategical and dispute avoidance advice.
  • Acted for the Employer in an DIAC arbitration in relation to extension of time claims, a call on the performance bonds and the subcontractor’s claims for extension of time and recovery for cost to complete the works in connection with a major mix-use commercial, leisure and office development in Dubai under UAE law.
  • Acted for the D&C Subcontractor in a dispute between the government and project co concerning contractual claims, including liability for site conditions and contamination, for one of Victoria’s largest road and tunnel projects. The dispute was for approximately AUD4 billion and was under Australian law.
  • Acted for the D&C Subcontractor in a dispute concerning the cost of the final design and the contractor’s claims for extensions of time and additional money claims in connection with a large rail and tunnel project in Victoria. The amount in dispute was approximately AUD1 billion and was under Australian law.
  • Acted for the FM subcontractor in a dispute concerning the delivery of the facility management services and applicable abatements for a state-of-the art and most expensive hospital project in Australia. The amount in dispute was approximately AUD1 billion, over the lifecycle of the FM subcontract.
  • Advised the Managing Contractor in a non-binding independent expert process concerning the contractor’s claims for extension of time and additional money claims in connection with a large hospital redevelopment.
