About

Agnieszka Lechman-Filipiak has more than 30 years of experience in employment law and corporate law.

She advises international corporations and leading Polish companies from various sectors, including technology, finance, energy, pharmaceutical and manufacturing, on models of engagement, termination of employment, employment-related aspects of restructuring, including collective redundancies and transfers of employing establishments. She also has extensive experience in the hiring of senior executives, and supports clients in issues related to discrimination, mobbing, unfair competition and working time.

Agnieszka is a member of the Steering Committee of UN Global Compact Network Poland. She supports organization members in the area of social sustainability, with a particular focus on human rights. Agnieszka speaks at conferences and runs training courses on various employment-related issues, as well as regularly writing articles for professional publications such as Praca i Zabezpieczenia Społeczne, Dziennik Gazeta Prawna and Rzeczpospolita.

EXPERIENCE

  • Assisting an international group from the manufacturing sector on establishing and operating a shared services centre in Poland, including advising on the requirements related to employment and the privacy aspects of recruiting, onboarding and employment conditions, preparing all necessary templates, policies, and internal regulations (taking into account the UK standards applicable within the group), and advising on the transfer of employees to the shared services centre under the Polish equivalent of TUPE regulations.
  • Advising a global industrial company operating in the infrastructure and technology sector on two comprehensive international restructuring projects involving collective redundancies and the carve out of a part of the business and its transfer to another legal entity, including assisting in the consultation process with the employee representatives.
  • Assisting numerous Polish and multinational clients from various sectors in collective redundancy projects.
  • Advising numerous Polish and multinational clients from various sectors on the engagement and remuneration of senior executives and top level managers, including the design, implementation and review of executive incentive and motivation schemes. This concerns, among other things, contractual arrangements, bonus and retention structures, long term incentive plans, and the alignment of executive compensation with corporate governance and regulatory requirements.
  • Supporting numerous Polish and multinational clients from various sectors in the implementation of remuneration and incentive schemes or introducing changes to existing ones.
  • Advising numerous clients from the IT sector on optimising remuneration frameworks, in particular implementing individual compensation structures for IT specialists and shaping progressive employment policies.
  • Providing on-going advice to clients from various sectors on a wide spectrum of employment matters, including working time arrangements, individual performance and disciplinary issues, equal treatment, equal pay, D&I, and the implementation of new bylaws to comply with new legislation, (e.g. the Gender Pay Gap Directive).
  • Assisting numerous Polish and multinational clients in internal investigations concerning employee misconduct and other breaches of the law.
  • Advising numerous Polish and multinational clients from various sectors on collective labour law issues, for example: providing strategic assistance in navigating complex relationships with trade unions and other employee representatives, including day-to-day cooperation and dispute resolution and advising in matters involving European Works Councils.
