Ignacio Abogabir concentrates his practice in corporate labor counseling and judicial representation of domestic and foreign clients in matters related to labor law, both individual and collective.

Ignacio regularly leads the representation of clients in complex judicial proceedings before labor courts, especially in matters related to violations of fundamental rights, union matters, and administrative claims.

With specific reference to union matters, he has extensive experience advising clients in all related aspects of union practices and regulations, and in regulated and non-regulated collective bargaining processes.

EXPERIENCE

  • A company specializing in the maintenance of construction machinery in subcontracting lawsuits. The Labor Court of La Serena declared that there was no subcontracting regime and, therefore, that the employee's responsibilities could not be extended to the company
  • A mining company in a lawsuit regarding a work accident resulting in the death of an employee hired by a contractor. DLA Piper successfully demonstrated that the client complied with its health and safety obligations
  • A company that manufactures and distributes leading international brands in cleaning, disinfection and cooking products, in relation to lawsuits brought against the company by employees or service providers
  • A regional construction company in its defense against a lawsuit brought by the director of a union federation alleging anti-union practices
  • A regional construction company in its representation in a lawsuit alleging unjustified dismissal brought by an employee who was dismissed for committing "reckless acts, omissions or imprudence." The claim was rejected in its entirety
  • A pharma company in the defense, in a complex labour litigation. The plaintiff, a former union board member, alleges that her termination was discriminatory due to her union affiliation and her role as a witness in several litigations against the company
  • A fashion retail company in the defense in Court against a complex labor trial for wrongful termination of an employee on the legal grounds of a serious breach of contract obligation
  • A retail holding company in a legal claim to reject fines that had been applied various times for the same infringement affecting different employees. The Court recognized that the company should not be fined more than once for the same infringement, thereby annulling the fines
  • A retail holding company in its defense in a complex labor trial for wrongful dismissal of an employee. Our team successfully proved that the employee did not comply with the Company's protocols
  • A dairy products manufacturing company in its defense against a claim for moral damages due to an injury suffered by a temporary services company employee on its premises

Prior Experience

Prior to joining DLA Piper, Ignacio served as a counselor in the Legal-Legislative Division of Chile's Ministry of the General Secretariat of the Presidency, the Ministry of Labor and Social Security and Ministry of Agriculture. Additionally, he worked as an associate at a global law firm.
