Amy’s main focus is on planning applications for large, mixed- use urban extensions and other large redevelopment schemes. Such work includes advising on environmental impact assessments, ecology issues, planning policy and strategic issues, planning obligations and the community infrastructure levy. Additionally Amy is very experienced in both making compulsory purchase orders and advising on compensation.

Amy has advised Argent Estates Plc since 2012 in relation to their high profile strategic city centre redevelopment scheme at Paradise in Birmingham, where she helped secure planning permission for the original scheme, structure planning obligations, and advised on EIA and listed buildings issues. She also provides a broad range of advice for HS2 Ltd in particular in relation to their use of their powers given to them under the High Speed Rail (London – West Midlands) Act 2017 and on issues arising in compensation for compulsory acquisition.

The experience below focuses on just some of the projects which Amy has advised on. Many of the projects have been selected because they demonstrate Amy’s technical expertise and ability to develop solutions and provide pragmatic advice to her clients.

Amy is a member of DLA Piper UK LLP’s Birmingham planning team which is ranked number 1 by Legal 500, 2020 which also places her as a “rising star”.

EXPERIENCE

Transport

  • HS2 Limited in relation to claims for compensation for land which has been acquired for Phase 1 of the delivery of the high speed railway, including on issues around certificates of lawful use and development. Amy was a senior member of the team advising on a claim for equivalent reinstatement and a relocation of a business whose land was required for the railway. There were issues of timing to ensure replacement facilities were useable prior to the land being acquired, and parameters were set to limit the compensation so that it only covered replacement of the facility. This matter is ongoing.
  • Highways England on the content of requirements to be used as a standard document for reference on their development consent orders. Amy led the drafting and technical response to this instruction. Project completion: Summer 2019.
  • Moto in relation to compensation for the compulsory acquisition of land at their services stations. Amy has most recently been advising on their claim at the Todhills where a complication jigsaw of land interests had to be unpicked before compensation could be finalised. Project Completion: June 2018.

Residential

  • North Lincolnshire Council on a planning application for residential development of up to 2,500 dwellings as part of a strategic development site known as Lincolnshire Lakes, including drafting a section 106 planning agreement to provide associated infrastructure (schools, open space, public transport and a lake) as well as dealing with the de-trunking of the M181 and working on agreements which will be entered by the developer, Council as highways authority and Highways England. Project is ongoing.

Regeneration and Redevelopment

  • Argent Estates Plc (who was in a joint venture with Birmingham City Council) for whom she helped secure planning permission (including compatibility with planning policy, the negotiation of planning obligations and advice on EIA) for the redevelopment of Paradise Circus, a major strategic redevelopment for the city of Birmingham and she continues to advise in relation to ongoing applications including for a new build to rent building within the site. Project Value: GBP700m. Project is ongoing.
  • the proposed regeneration of a large part of Digbeth, Birmingham by Oval Real Estate, including reviewing the planning application and environmental statement, advising on the integration of design principles as well as structuring a complex section 106 obligation, with a viability review mechanism. Project Value: GBP 1 billion. Project is ongoing.
  • Northampton Borough Council on planning agreements in relation to 4 sustainable urban extensions (each of around 1,000 dwellings). The agreements included viability mechanisms as well as open space and affordable housing provision amongst other things. Project Completion: July 2015.
  • Norfolk Homes Limited providing strategic advice on the promotion of a 1,800 residential development, extending the village of Long Stratton in Norfolk. Project is ongoing.
  • Coventry City Council for the compulsory acquisition of land in a historic quarter for the regeneration scheme known as Far Gosford Street. Project Completion: January 2012.

Compulsory Purchase

  • Nottinghamshire County Council on a claim for compensation for compulsory purchase. Amy was part of a team which was successful in reducing the claim by over GBP5m. The advice included certificates of alternative appropriate development. Project Completion: December 2012.
  • HS2 Limited in relation to the claims for compensation of sites near to the new Curzon Street station in Birmingham. Amy is part of a team advising on the appeal of certificates for alternative appropriate development on these sites. Project is ongoing.
  • Coventry City Council on the compulsory acquisition of land in a historic quarter for the regeneration scheme known as Far Gosford Street. Project Completion: January 2012.
  • Norfolk Homes in relation for a claim for compensation for a very small area of land which lay in the middle of a site for residential development. The main issues surrounded the hypothetical no scheme world. Project completion: December 2018.
