Becky Caruso is a trial attorney with a diverse nationwide high-stakes litigation practice. With over 15 years' experience, Becky focuses on antitrust, complex commercial litigation, class action, and business and contract disputes.

Becky's practice includes representation of clients across a wide array of industries, including real estate, construction, technology, health and beauty products, insurance, and food sales and distribution. Becky engages in pre-litigation counseling and zealously represents clients in all phases of litigation through trial.

Her antitrust experience includes representing clients in federal and state courts involving allegations of violations of Sections 1 and 2 of the Sherman Act and state antitrust consumer protection laws, monopolization, price fixing, bid rigging, exclusionary conduct, and other restraints of trade, as well as class action. Becky also counsels clients for Department of Justice and Federal Trade Commission investigations, mergers and acquisitions, employee training, and the use of artificial intelligence (AI) and algorithmic software.

EXPERIENCE

  • Representing property management company in multidistrict litigation class action, and related suits nationwide involving the use of algorithmic pricing software and allegations of inflated rental prices
  • Representing large organic grocery chain as a plaintiff in federal court arising out of a construction defect dispute against general contractor, subcontractors, and engineers
  • Obtained complete summary judgment on behalf of insurance company in New Jersey state court related to earned premium clause in insurance contract
  • Brought lawsuit on behalf of plaintiffs, generic pharmaceutical company and drug developer, against Japanese drug manufacturer in Southern District of New York, alleging that defendant conspired with a different pharmaceutical company to preserve its monopoly position over the key active pharmaceutical ingredient (API) in the US market by refusing to supply the API to potential market competitors, and preventing generic versions of the drug at issue from entering the market. Defeated motion to dismiss, resulting in favorable early resolution
  • Represented third-party restaurant franchises in antitrust class action involving alleged no-poach agreements
  • Represented real estate broker in Texas federal court antitrust class actions involving realtor commissions and allegations of artificially inflated realtor fees
  • Represented foodservice distribution company as an opt out plaintiff in nationwide price fixing cases against the nation's largest chicken, pork, and beef producers
  • Represented a company in the market for environmental risk assessment data for property assessments in bringing affirmative claim under Section 2 of the Sherman Act against the market leader. Case involves claims of sham litigation, copyright infringement, improper product bundling, and business disparagement. Secured partial summary judgment on the merits in client's favor in Southern District of New York
