Lindsey Dieselman advises clients on complex cross-border investigations and government enforcement matters, including those involving bribery, corruption, sanctions, export controls, asset tracing, and national security concerns. Lindsey brings experience spanning the entire life cycle of investigations and enforcement actions from risk assessment and identification of misconduct through remediation and resolution. She routinely works with companies and individuals to identify, investigate, and mitigate US criminal, regulatory, and civil enforcement risks.

Lindsey's investigations practice encompasses both internal and government-facing investigations. She has represented clients before US regulators and enforcement authorities including the US Department of Justice (DOJ), US Securities and Exchange Commission (SEC), US Department of State's Directorate of Defense Trade Controls (DDTC), US Department of Commerce's Bureau of Industry and Security (BIS), US Department of the Treasury's Office of Foreign Assets Control (OFAC), and US Customs and Border Protection (CBP). She has also represented clients in matters before non-governmental organizations including the World Bank Group. Lindsey is experienced in managing government inquiries involving complex data collection elements, including grand jury and administrative subpoenas, controlled unclassified data (CUI), data controlled under the International Traffic in Arms Regulations (ITAR), nationally sensitive data, blocking statutes, Mutual Legal Assistance requests, and cross-border data privacy restrictions.

Lindsey has also worked closely with client to design and implement effective compliance programs for US anticorruption, sanctions, and export control laws, including the Foreign Corrupt Practices Act (FCPA) and ITAR. Lindsey also supports clients in conducting anticorruption and trade controls diligence in transactional matters.

EXPERIENCE

  • Represented a European aerospace and defense company before DOJ regarding allegations of bribery and export control violations, resulting in a favorable deferred prosecution agreement (DPA) for the company as part of a coordinated resolution with UK and French criminal enforcement authorities, and continued with the completion of investigation and compliance DPA obligations
  • Represented a European transportation company as successor to an entity under investigation by the World Bank Group's Integrity Vice Presidency (INT) regarding allegations of corruption
  • Represented two employees of a US defense company in connection with DOJ and SEC investigations into allegations of bribery and corruption related to sales campaigns in the Middle East
  • Represented a US life sciences company regarding compliance with DOJ and SEC subpoenas issued in connection with an insider trading and fraud investigation
  • Represented a European company in connection with a voluntary disclosure to DOJ under DOJ's Mergers and Acquisitions Safe Harbor Policy regarding allegations of corruption concerning an acquired subsidiary
  • Designed a sanctions compliance program for a South American company and evaluated its US sanctions compliance risk
  • Represented US, Canadian, and European companies regarding risk assessments and internal investigations into allegations of diversion of products to sanctioned jurisdictions or end users
  • Represented US manufacturing companies in connection with matters before CBP relating to seized goods and improper calculation of duties owed for imports
  • Represented a European company before OFAC and DOJ concerning the investigation and voluntary self-disclosure of apparent violations of US sanctions regulations relating to Russia
  • Assessed and improved the anticorruption and antibribery compliance policy of a publicly traded US real estate company
  • Represented a US life sciences company regarding administrative subpoenas issued by BIS in connection with company exports and re-exports
  • Evaluated and enhanced a US defense company's trade controls compliance policies

Pro Bono

Lindsey maintains a robust pro bono practice and has represented clients on matters concerning voting rights, election law, expungement of prior criminal records, housing conditions, and allegations of police torture. Lindsey has also helped non-profit organizations develop anticorruption compliance policies.
